USCIS announced on August 28, 2009 that it is still accepting H-1B Visa petitions towards the H-1B cap for FY2010. The updated numbers reflect that USCIS has received 45,100 H-1B cap petitions. The H-1B visa is for individuals who have an offer of employment in specialty occupation, and who are seeking to enter the United States to work in their field of expertise. A ‘specialty occupation’ is one which requires the minimum of a baccalaureate degree or its equivalent. Speciality occupations include, but are not limited to, accountants, lawyers, doctors, engineers, graphic designers, and various analysts. I am a Canadian Citizen looking to work in the USA. I currently hold a Michigan Nursing License as a Licensed Practical Nurse. I have 14 years of continuous nursing experience, specializing in psychiatric nursing and psycho-geriatric nursing. Do I qualify for a work Visa, and if so, what is the first step.
